A Treatise on Human Life An Unalienable Right by Harold D. Kletschka, M.D. Reviewed by Rev. Kenneth P. Kothe* April 28, 2004 The Roe v. Wade decision never would have been resulted in the legalization of abortion had A Treatise on Human Life been available to the U.S. Supreme Court. Dr. Harold Kletschka states the case with clarity and unimpeachable proof borne out of his career as a research scientist. Dr. Kletschka, recently deceased, began researching Common Law aspects of abortion 20 years ago. He assembled documents dating to as early as the Fifth Century A.D. that directly address the question of how English Common Law courts addressed abortion. Those edicts, issued by the Roman Catholic Church, Kletschka shows, were absolutely binding on the civil law. Dr. Kletschka held unique qualifications that made it possible for him to author such a book. As a board-certified thoracic, general and cardiovascular surgeon, he understood human physiology. Holding a law degree from Blackstone School of law he understood the legal aspects surrounding the question. As the research scientist who invented the Kletschka-Rafferty Artificial Heart, and whose Bio-Pump® is the largest selling heart assist blood pump in the world, he demonstrated the academic rigor required to provide such stellar research. Two years ago, Dr. Kletschka finally brought focus to more than two decades of research as he began recording his findings. In Section I, where he defines human life as a continuum beginning with the splitting of the zygote and progressing into eternity. Science, philosophy and faith, Kletschka forcefully argues, all prove the unique Godly nature of human life. Section II is devoted to an in-depth study of Common Law and abortion. Dr. Kletschka shows us the actual quotations, written oftentimes in their ancient styles, as the law condemned abortion at every stage of gestation. He puts to rest the argument that only after quickening is abortion punishable as an offense, an argument used by some pro-abortion advocates to allow early term abortions. In Section III, Dr. Kletschka uses the proofs he has built earlier in the book to analyze the Roe v. Wade decision and show how it was based on poor, even fraudulent scholarship. No argument offered by the Supreme Court can withstand the doctor’s analysis and application of law to this question. Dr. Kletschka was a Roman Catholic, and his serious study of Catholic doctrine can be seen on the pages of this book. Yet, as we know, the contributions of the Roman Catholic Church to the formation of Common Law are indisputable. They are part of our history and foundational to our system of law. One can, and we often do, argue with Catholic theology, but with historical fact, we can remain aligned. Certainly, there is nothing in this book with which Luther would have disagreed.
